These Terms and Conditions govern access to the website and purchases made through MEDICUBE EUROPE. By placing an order, the customer declares that they have read the pre-contractual information, these Terms and the referenced policies.
1. Seller and contact details
The MEDICUBE EUROPE online store is operated by BEAUTY & BEAUTY S.R.L., Italian VAT and tax identification number 01026380459, EU VAT number IT01026380459, REA 107045, with its registered office at Corso Vannucci 22, 06121 Perugia (PG), Italy. Email: info@medicube-europe.com. Certified email (PEC): beauty-beauty@pec.it.
2. Scope
These Terms apply to consumers and, where compatible, business customers. Mandatory protections under the Italian Consumer Code and European Union law remain fully applicable to consumers.
3. Products and information
We present features, images, ingredients, compatibility and instructions as accurately as possible. Shades, packaging or graphic details may vary due to manufacturer updates without changing the essential characteristics. In the event of updates, information on the packaging and in the manual supplied with the product takes precedence.
Cosmetics and beauty-tech devices do not replace medical diagnosis or treatment. Customers must read the label, warnings and manual before use, perform a skin test where indicated and discontinue use if adverse reactions occur.
4. Orders and formation of the contract
Submitting an order constitutes an offer to purchase. The contract is formed when we send the order confirmation, subject to successful payment and fraud checks. We may refuse or cancel an order and refund any amount received in the event of unavailability, an obvious pricing error, incomplete details, suspected fraud, breach of these Terms or inability to deliver.
5. Prices, taxes and promotions
Prices are stated in euros and include VAT and customs charges. No additional VAT, duty or customs clearance charges are due on delivery. Shipping costs and other amounts are shown before payment. Promotions apply for the stated period and under the stated conditions, while any specified quantities last, and may not be combined. An obviously incorrect price does not bind the seller. Before cancelling the order, we will notify the customer and refund the amount paid.
6. Payments
The store uses WordPress and WooCommerce on WordPress.com. Third-party services enabled on the site are subject to their respective data protection policies.
7. Shipping and delivery
8. Withdrawal, returns and refunds
Consumers may exercise their right of withdrawal within 14 days of delivery without giving a reason, following the procedure described in our Returns and Refunds Policy. Statutory exceptions remain applicable, including the exception for sealed goods that are unsuitable for return for health protection or hygiene reasons and have been opened after delivery.
9. Statutory conformity warranty
Consumers benefit from the statutory conformity warranty provided by applicable law, generally for two years from delivery. For defective or non-conforming products, contact support with the order number and useful documentation. Statutory remedies are not limited by any commercial warranty.
10. Correct use of devices
Devices must be used only in accordance with the manufacturer’s manual and warnings. Do not use on injured or inflamed skin or where the stated contraindications apply. If pregnant, using implanted medical devices, affected by a medical condition or in doubt, consult a healthcare professional before use. MEDICUBE EUROPE is not liable for damage resulting from use contrary to the instructions, subject to mandatory legal provisions.
11. Intellectual property
Texts, trademarks, logos, photographs, videos, graphics and software on the website are protected by applicable law and belong to their respective owners or are used with permission. They may not be copied, distributed or commercially exploited without authorisation.
12. Prohibited conduct
It is prohibited to use the website for unlawful purposes, attempt unauthorised access, interfere with security or operation, introduce malicious code, collect other users’ data or place fraudulent orders.
13. Third-party services and links
The store uses WordPress and WooCommerce on WordPress.com. Third-party services enabled on the site are subject to their respective data protection policies.
14. Liability
No provision excludes or limits liability where prohibited by law or limits mandatory consumer rights. To the extent permitted, we are not liable for temporary interruptions, events outside our reasonable control or damage caused by improper use of products.
15. Governing law and disputes
These Terms are governed by Italian law, without prejudice to mandatory rules in the consumer’s country of residence. For consumer disputes, the court of the consumer’s place of residence or domicile has jurisdiction where provided by law. Before initiating a dispute, please contact us to seek an amicable resolution.
16. Amendments
We may update these Terms for operational or legal reasons. The version applicable to each purchase is the one published when the order is placed. The invalidity of any clause does not affect the remaining provisions.
